WHAT IS THE TRANSFER OF LAND?
If you are a purchaser we will prepare the transfer of land document ready for your execution. As a purchaser this document is usually signed firstly by you then forwarded on to the seller’s agent for execution by the seller.

As the name of the documents suggests this is a very important legal document, through the whole settlement process ultimately the Transfer of Land is the document that will transfer the property out of the Sellers Name and into the name of the new owners.

This document must be prepared and executed with absolute accuracy as any discrepancies may cause settlement to be delayed.

After settlement the purchaser’s agent or bank will lodge the documents with Landgate together with the appropriate registration fee and the ownership details will be changed in the register.

HOW TO EXECUTE A TRANSFER OF LAND

The execution of the Transfer of Land depends upon the person or entity purchasing the land. The parties to a transaction should not witness each others signature.

The witness must be a person over the age of eighteen who is not a party to the transaction and who must state his or her full name, address, occupation and daytime telephone number.
